一般, 在纽约州, a bias/hate crime occurs when a person commits a specified criminal offense and is motivated in whole or in part by bias on the part of the offender toward the race, color, 国家的起源, 祖先, 性别, 宗教, 宗教活动, 年龄(60岁或以上), 残疾, or sexual orientation of the victim.

Penalties for hate crimes 在纽约州 range from monetary fines up to a minimum of twenty (20) years in prison, depending on the nature of a specific offense. Specific information regarding hate crime offenses and related penalties may be found in article 485 of the New York State Penal Law.

性取向: A preformed negative opinion or attitude toward a person or group of persons based on their actual or perceived sexual orientation. 

性别: A preformed negative opinion or attitude toward a person or group of persons based on their actual or perceived 性别, i.e.男性或女性. 

性别认同: A preformed negative opinion or attitude toward a person or group of persons based on their actual or perceived 性别 identity, e.g., bias against trans性别 or 性别 non-conforming individuals. 

种族: A preformed negative opinion or attitude toward a group of persons whose members identify with each other, 通过共同的遗产, often consisting of a common language, common culture (often including shared a shared 宗教), and/or ideology that stress common 祖先. 

国籍: A preformed negative opinion or attitude toward a group of people based on their actual or perceived country of birth. 

残疾: A preformed negative opinion or attitude toward a group of persons based on their physical or mental impairments, whether such 残疾 is temporary or permanent, congenital or acquired by heredity, 事故, 受伤, 先进的时代, 或疾病.
